Terms of Use

1. General provisions

The website siguldasrudensbumba.lv (hereinafter – the online shop) is operated, and the product is sold, by SIA VIROLANS, registration No. 40003509311, registered address: Pērkona iela 12, Sigulda, Siguldas novads, LV-2150, Latvia (hereinafter – the Seller). The online shop sells one product – the handmade souvenir "Siguldas Rudens Bumba" (the Sigulda Autumn Globe; hereinafter – the Product).

The Buyer is a natural or legal person who places an order in the online shop. To place an order, the Buyer provides their name, e-mail address, phone number and delivery address; these data are used only to fulfil the order and to communicate with the Buyer, in accordance with the Privacy Policy.

By placing an order in the online shop, the Buyer confirms that they have read and agree to these Terms of Use, the Right of Withdrawal conditions and the Privacy Policy. When a consumer purchases the Product through the online shop, the agreement is considered a distance contract governed by the Consumer Rights Protection Law of the Republic of Latvia and Cabinet Regulation No. 255 "Regulations on Distance Contracts".

Product images in the online shop are for illustration. As every Sigulda Autumn Globe is made by hand, individual details, colour shades and the arrangement of the leaves may differ slightly from the images; this is not considered a lack of conformity with the contract.

2. Placing an order

The Product is the handmade souvenir "Siguldas Rudens Bumba" (the Sigulda Autumn Globe) – a decorative autumn globe with a golden-autumn scene of Sigulda in which autumn leaves swirl when the globe is shaken. The price of the Product is EUR 28.00 per item. A detailed description of the Product is available in the "Buy" section. All prices are in euro and include value added tax. The delivery fee is added to the order total and is shown before payment.

To place an order, the Buyer selects the quantity in the "Buy" section, fills in the order form (name, e-mail, phone, delivery address), confirms agreement with these terms and clicks the payment button, after which they are redirected to a secure payment environment. The order is considered placed, and the contract enters into force, when the payment has been successfully received.

After successful payment the Buyer receives an order confirmation with the order number at the e-mail address provided. The Buyer is responsible for the accuracy of the details given in the order; if delivery is not possible because of an incorrectly stated address or contact details, the cost of redelivery is borne by the Buyer.

3. Payment

The settlement currency is the euro. The purchase can be paid for using one of the following payment methods:

The personal data required to make the payment are transferred to the licensed payment service provider that processes the payment. The Seller does not receive or store the Buyer's card or online-banking details.

If for any reason an order cannot be fulfilled, the Buyer is informed and the amount paid is refunded no later than within 14 days.

4. Delivery

Products are delivered within the territory of Latvia, Lithuania and Estonia. The delivery fee depends on the size of the parcel, which is determined by the number of Products: 1–4 Products – EUR 3.63, 5–8 Products – EUR 7.26, 9–16 Products – EUR 9.68 per order (delivery in Latvia). For delivery to Lithuania and Estonia: 1–4 Products – EUR 6.05, 5–8 Products – EUR 9.68, 9–16 Products – EUR 10.89 per order. The delivery fee is calculated automatically according to the number of Products and is shown before payment. Up to 16 Products can be purchased in one order.

Delivery is made by courier. The Product is dispatched to the address given by the Buyer usually within 5 working days of receipt of payment. In exceptional cases the delivery time may be longer, but no more than 30 calendar days; the Buyer is informed of this by e-mail.

5. Right of withdrawal

A consumer (a natural person) has the right to withdraw from the Product within 14 calendar days of receiving it.

To exercise the right of withdrawal, the Buyer sends an unambiguous statement to megijadesign@gmail.com within 14 days of receiving the Product, or fills in the withdrawal form on the website: Right of Withdrawal. After the form is submitted the Buyer receives a confirmation e-mail. Withdrawal notices received after the deadline are not accepted.

The Buyer must return the Product to the Seller without delay and no later than 14 days after sending the withdrawal notice. The direct cost of returning the Product is borne by the Buyer, except where the product does not conform to the order (wrong or damaged product). The Buyer bears the risk of damage to or loss of the Product during return shipping; cash-on-delivery parcels are not accepted.

The Product must be returned to the following address: Pērkona iela 12, Sigulda, Siguldas novads, LV-2150, Latvia.

While exercising the right of withdrawal, the Buyer is responsible for preserving the quality and safety of the Product. The Product must be returned unused, undamaged, complete and in its original packaging with all protective materials. If the Product has been used beyond what is necessary to establish its nature, characteristics and functioning, or is damaged, scratched, shows signs of wear or is returned without its original packaging, the Seller is entitled to reduce the refund in proportion to the diminished value of the Product (in the case of significant damage – up to the full price of the Product).

A Product can be returned if it is unused, undamaged and in its original packaging. The right of withdrawal does not apply to a Product made to the Buyer's specifications or clearly personalised.

After the returned Product has been received and its condition checked, the Seller refunds, no later than within 14 days, the amount paid for the Product and the original delivery cost up to the cost of the cheapest delivery option offered, using the same payment method the Buyer used for the purchase. If the Buyer chose a more expensive delivery option than the cheapest one offered, the difference is not refunded. The Seller is entitled to withhold the refund until the Product has been received back or the Buyer has provided proof of its dispatch.

The Seller is not liable for delays in or failure to perform its obligations caused by circumstances beyond the Seller's reasonable control.

The Seller reserves the right to refuse to sell the Product and to request its return if the price shown in the online shop is, by mistake, significantly lower than its market price.

6. Consumer rights regarding a non-conforming product

The Seller is liable for any lack of conformity of the Product with the contract that becomes apparent within 2 years of the date of delivery. If a lack of conformity becomes apparent within the first year after delivery, it is presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the Product or the nature of the lack of conformity.

The Buyer must inform the Seller of a lack of conformity within 2 months of discovering it, by writing to megijadesign@gmail.com and stating the order number and a description of the defect, attaching photographs where possible.

If the Product has defects for which the Seller is responsible, the Buyer is entitled to request repair or replacement of the Product free of charge. If this is not possible or would be disproportionate, the Buyer is entitled to an appropriate price reduction or to cancel the contract and receive a refund. The Seller is not liable for damage caused by careless use, dropping, improper care or natural wear and tear.

The Seller provides a written reply to a consumer complaint within 15 working days.

7. Processing of the Buyer's personal data

The Seller processes only the personal data provided by the Buyer in the order form (name, e-mail, phone, delivery address), and only for the purposes of fulfilling and delivering the order, accounting and ensuring consumer rights. The data are transferred to the licensed payment service provider to process the payment and to the delivery service provider to deliver the Product.

8. Intellectual property

The design of the Sigulda Autumn Globe is a registered design at the Patent Office of the Republic of Latvia. The Product design, the website texts, photographs, illustrations and logo are the intellectual property of the Seller and the designer Megija Baumane. Copying, reproducing, publishing or using them for commercial purposes without written permission is prohibited.

9. Cancelling an order

The Buyer may cancel an order before it has been dispatched by writing to megijadesign@gmail.com and stating the order number.

If the Product has not yet been handed over to the delivery service provider, the Seller cancels the order and refunds the full amount received, including the delivery fee, no later than within 14 days, using the same payment method the Buyer used for the purchase.

If the Product has already been dispatched, the order can no longer be cancelled, but the Buyer may exercise the right of withdrawal under section 5 of these terms.

10. Dispute resolution

These terms and the contract between the Buyer and the Seller are governed by the laws of the Republic of Latvia.

If the Buyer has a complaint about the Product or the service, it must first be submitted to the Seller in writing at megijadesign@gmail.com. The Seller provides a written reply within 15 working days.

If the dispute cannot be settled by agreement, the consumer may turn to the Consumer Rights Protection Centre (Patērētāju tiesību aizsardzības centrs, Talejas iela 1, Riga, LV-1026, pasts@ptac.gov.lv, phone +371 65452554, www.ptac.gov.lv) or to the Consumer Dispute Resolution Commission operating under it.

Disputes not settled out of court are heard by a court of the Republic of Latvia.
